Orange County DUI Case

Our client was charged with one count of driving under the influence of alcohol (Vehicle Code § 23152(a)), a misdemeanor, one count of violation of driving while having a 0.08% or higher blood alcohol level (Vehicle Code § 23152(b)), also a misdemeanor, as well as one count of violation of driver motor vehicle without a valid license (Vehicle Code § 12500(a)). The last charge, of driving without a valid driver's license, was our client's third such charge over the last two years.

Our client, an illegal alien, was arrested after police officers stopped her vehicle at about 10:30 p.m. when she was allegedly driving without her headlights on. Our client was extremely concerned about the immigration consequences of the arrest and charges. She was also concerned that having a DUI on her record would affect her ability to work as a nanny, which required her to drive children from place to place on a daily basis. She registered a 0.10 blood alcohol level at the scene.

The case was filed in Westminister (Orange County). Greg Hill of Greg Hill & Associates (formerly John Hill & Associates) negotiated a plea bargain for the client in which the District Attorney agreed to drop all charges in exchange for our client pleading no contest to a "wet reckless." The client was happy, as this plea allowed her to state to her employer that she had not been convicted of DUI, helping her maintain her job.
