Our client was charged with violating probation, for an underlying charge of possession of a controlled substance (Health & Safety Code § 11377(a)), his second such charge.
Our client had completed the Prop 36 classes, but had tested “dirty” in one random test. Consequently, he was assigned additional classes, which he did not complete.
Police stopped our client on a warrant when he failed to appear for a progress hearing on his 11377 charge. Our client was working at the time.
The underlying case was out of Pomona Superior Court. Due to his two priors, he faced a total of six years in state prison if convicted of violating probation. With nearly 150 days of credit, and anticipated good time credit, it seems likely that our client will return to his family and leave prison in a little over one year. The client’s family was very happy, as they were prepared for a six year term.
